CONSENT TO PROCESSING OF FACIAL IMAGES AND VOICE RECORDINGS

I, the User of the PromoOS Service (https://account.promoos.tech), by uploading a facial image and/or a voice recording and by ticking the box “I consent to the processing of the facial image and voice recording”, freely, of my own will and in my own interest, give specific, informed and conscious consent to the processing of these data on the following terms.

1. Operator

OsOO «Promoos» («PromoOS» LLC), registration number 329936-3301-ООО, TIN 00906202610151, address: 64b Erkindik Avenue, Pervomaisky District, Bishkek, Kyrgyz Republic, email: support@promoos.tech.

2. Data processed

  • photographs and video recordings showing my face that I have uploaded to the Service;
  • audio and video recordings of my voice that I have uploaded to the Service;
  • the AI avatar and voice model created by the Service on the basis of these materials.

3. Purpose of processing

The sole purpose is to create, at my request, an AI avatar, videos featuring the AI avatar and voice-overs in my voice (a voice clone), and to deliver this Content to me in the Service.

The Operator does not use these data to establish my identity, for authentication, facial recognition, profiling or any other purposes unrelated to the generation of the Content I have requested. Accordingly, the Operator does not process these data as biometric personal data.

4. Actions performed with the data

Receipt, recording, storage, use for generation, transfer to AI providers, deletion — by automated means.

5. Transfer to third parties and cross-border transfer

I agree to the transfer of the uploaded materials to the AI providers that carry out the generation, to the extent necessary to fulfil my request. The servers of these providers may be located outside the Russian Federation and the Kyrgyz Republic, including in the USA. The current list of providers and countries is published at https://promoos.tech/en/subprocessors.

6. Retention periods

  • uploaded photographs, videos and audio recordings, the AI avatar and voice model created, and the Content generated with them are stored in my Account so that I can reuse them — until I delete them, until this consent is withdrawn or until the Account is deleted.

7. Images and voices of other people

If I upload a facial image or voice recording of another person, I confirm that I have obtained from that person (or their legal representative) express consent to the creation of an AI avatar or voice clone and to their use for the purposes for which I will use the Content. At the Operator’s request, I will provide confirmation of such consent. Creating an AI avatar or voice clone of a person without their consent is prohibited by clause 2.4.4 of the Acceptable Use Policy (https://promoos.tech/en/aup). I undertake not to upload facial images or voice recordings of persons under 18 years of age.

8. Term and withdrawal

This consent remains in effect until it is withdrawn or the Account is deleted. I may withdraw my consent in the Account settings or by sending a request to support@promoos.tech. After withdrawal, the Operator deletes the uploaded materials, the AI avatar and the voice model within 10 business days. Content that I have already downloaded or published remains at my disposal and under my responsibility. Withdrawal of consent makes it impossible to use the AI avatar and voice clone features, but does not affect the other features of the Service.

9. Miscellaneous

This consent is given separately from the Consent to Personal Data Processing (https://promoos.tech/en/consent) and is not a condition for using the Service as a whole. The processing procedure is described in Section 3.4 of the Privacy Policy (https://promoos.tech/en/privacy).
